General Terms and Conditions Rainbow Gemstones

 

  

Article 1 - Applicability:

 

1. These general Terms and Conditions apply to every offer from Rainbow Edelstenen and to every distance contract concluded between Rainbow Edelstenen and the (potential) buyer.

 

2. Rainbow Gemstones will only process orders after payment has been received. The agreement is concluded once the order is placed and is binding once payment has been made.

 

3. Accepting an offer or placing an order (whether in writing or verbally) means that the applicability of these Conditions is accepted by the (potential) buyer.

 

4. Before payment for the order is made, the text of these General Terms and Conditions will be made available to the (potential) buyer.

 

 

Article 2 – Prices & Payments:

 

1. The listed or quoted prices for the products offered at Rainbow Gemstones are in euros (including VAT), any taxes and/or other levies, unless otherwise stated or agreed. Special offers are only valid within the specified period and while supplies last.

 

2. Rainbow Gemstones offers various discounts, including the "Welcome Discount" and "Loyal Customer Discount." The Welcome Discount is 15% of the purchase amount. The Loyal Customer Discount is 10% of the purchase amount for every 5th order; for example, for the 5th, 10th, 15th, etc., order. If multiple discounts apply to the same purchase, Rainbow Gemstones will calculate them twice, starting with the fixed discount, namely the Welcome Discount or Loyal Customer Discount. If there is an additional discount, it will be calculated on the remaining amount after calculating the first discount, as described above. In the case of valid offers at the time of the order, the Welcome Discount or Loyal Customer Discount will be calculated on the amount of the offer in effect at the time of the order. Any additional discount will then be canceled.

 

3. Rainbow Edelstenen's prices, offers, and applicable discounts are non-binding. Rainbow Edelstenen always reserves the right to change prices, offers, and discounts, particularly when required by (legal) regulations. If the total price is lower than the purchase price due to the discounts given, the purchase price will be used and will be considered the total amount payable. No rights can be derived from typographical or pricing errors (for example, in the case of obvious mistakes).

 

4. The price agreed upon (both in writing and verbally) will remain valid until the order has been completed and will not be changed during the ordering process by the (potential) buyer.

 

5. The order will be prepared and shipped by Rainbow Edelstenen as soon as the (potential) buyer has completed Rainbow Edelstenen's payment request. When submitting a payment request, Rainbow Edelstenen will include the invoice to ensure there are no misunderstandings regarding the agreed-upon price.

 

6. Unless otherwise agreed, advance payment must be made. This can be done via iDeal on the website (as soon as it is available) or by bank transfer after receipt of the invoice.

 

7. Shipping costs will be clearly stated on the invoice and will be charged to the (potential) buyer. The price depends on the product ordered. Rainbow Gemstones will inform the (potential) buyer of this in advance.

 

 

Article 3 - Delivery:

 

1. Images and information about products, verbal or written communications (via email, WhatsApp, or social media) regarding offers, discounts, and (the most important) product features, are presented or stated as accurately as possible. However, Rainbow Gemstones does not guarantee that all products fully correspond to the information provided.

 

Due to the unique nature of gemstones, slight variations in color, shape, and size may occur. This does not in itself constitute grounds for cancellation or compensation, unless the product deviates significantly from the description. Gemstones (and minerals) are natural products and all have a unique character with external characteristics.

 

2. Ordered and paid products will be shipped by Rainbow Edelstenen as soon as possible. However, the expected arrival time may vary per delivery and depends on whether the product is in stock at the time of order. Rainbow Edelstenen will inform the (potential) buyer of this and (if available) provide the Track & Trace code from the postal company, send it (by email, WhatsApp, or social media), or communicate it verbally. The expected delivery time stated by Rainbow Edelstenen is always subject to change and depends on delivery by the postal company that shipped the product.

 

3. If a product, for whatever reason, is unexpectedly no longer available, Rainbow Edelstenen will refund the (potential) buyer the (prepaid) amount (if any) for the ordered and undeliverable product as soon as possible.

 

 

 

Article 4 – Returns Policy & Cancellation:

 

1. The (potential) buyer has the right to cancel the purchase or order within 14 days without giving any reason (right of withdrawal). The withdrawal period begins on the day the order is received.

 

2. If the delivered product(s) do not meet expectations, the buyer can return them to Rainbow Edelstenen within 14 days of delivery. Returning one or more products is at the buyer's expense. Rainbow Edelstenen's address can be found on the included return address sticker and is listed on the enclosed return slip.

 

3. If the return period, as described in point 2 above, has expired, the buyer can no longer return the ordered product. The buyer is then no longer entitled to any refund from Rainbow Gemstones.

 

4. When returning one or more products within the stated period, the buyer will be refunded the amount paid for the returned product(s) as soon as possible by Rainbow Edelstenen once the product has been received at the return address of Rainbow Edelstenen.

 

PLEASE NOTE! Returned products will only be refunded if they are unused and in their original packaging and the return slip is fully completed and enclosed.

 

 

 

Article 5 – Liability and Loss or Damage:

 

1. Loss - If the buyer has returned one or more products and they have not arrived at Rainbow Edelstenen within the 14-day period, Rainbow Edelstenen will request proof of shipment with the Track & Trace code clearly showing Rainbow Edelstenen's return address. Rainbow Edelstenen will then initiate an investigation with the postal company after first checking the weight of the packaging.

 

IMPORTANT: If the return weighs less than 100 grams for a box and 7 grams for a (bubble) envelope, the returned packaging can be assumed to be empty, and the buyer is not entitled to a (full) refund of the product costs paid. Therefore, no investigation will be conducted with the postal company.

 

2. Damage - All products are shipped carefully and securely by Rainbow Edelstenen. If one or more products arrive damaged, Rainbow Edelstenen wants to assess the damage as accurately as possible. To this end, the buyer must report the damage to Rainbow Edelstenen in writing within 3 days of receipt, including a clear photo of the packaging, the (damage to the) outer and inner packaging, the shipping label, and the damaged product. If the buyer does not comply with these conditions, Rainbow Edelstenen will not reimburse the buyer for the damaged product.

 

3. Rainbow Gemstones reserves the right to reject the reported damage if, in all fairness, the investigation of the damage reveals that the damage report is not sufficiently justified. Of course, the buyer is entitled to a product that matches the order.

 

4. Liability – Rainbow Gemstones products are not suitable for children under 3 years of age. This also applies to jewelry, such as children's bracelets. Rainbow Gemstones products are not suitable for internal use, unless specifically indicated on the product. Handle the products with care and always be aware of sharp points or edges.

 

5. Rainbow Gemstones cannot be held fully liable for broken bracelets and/or necklaces when worn or if the damage is not reported within 3 days as described in point 2 of this article. Because the source of damage to a piece of jewelry is difficult to determine, Rainbow Gemstones will reimburse half of the amount paid for the damaged or broken piece of jewelry within 3 days of receipt.

Article 6 – Privacy & Complaints:

 

1. The information provided will be stored in Rainbow Edelstenen's administrative files. Rainbow Edelstenen respects the privacy of all website users and (potential) buyers. Rainbow Edelstenen ensures that personal information is always treated confidentially. Personal information will be used to process orders as smoothly as possible. Personal information will never be shared with third parties unaffiliated with Rainbow Edelstenen. For more information, Rainbow Edelstenen refers to the privacy statement. You can file a complaint with the Dutch Data Protection Authority.

 

2. Complaints can only be submitted in writing to service@rainbowedelstenen.nl and will be processed as soon as possible. Feedback on the submitted complaint will always be provided.

 

Dutch law applies to all agreements between Rainbow Gemstones and the buyer. Disputes are preferably resolved amicably. If this is not possible, the buyer may appeal to the competent court.
